NEW DELHI: Acquitting three persons of rape charges, the Supreme Court has ruled that a sex worker cannot lodge a sexual assault complaint against her customers if they refuse to pay.

A bench of Justices Pinaki Chandra Ghose and Amitava Roy said that though the evidence given by a woman alleging rape must get importance from the trial court, but it could not be taken as "gospel truth".

"The evidence of prosecutrix must be examined as that of an injured witness whose presence at the spot is probable but it can never be presumed that her statement should always, without exception, be taken as gospel truth," the bench said.

The ruling came in a 20-year-old case from Bengaluru. A woman, working as a maid, had alleged that three persons abducted her in an auto, took her to a garage and repeatedly raped her.

The three accused had challenged a Karnataka high court order directing their prosecution. The SC bench examined the witness all over again and said, "Her conduct during the alleged ordeal is also unlike a victim of rape and betrays somewhat submissive and consensual disposition."

In her statement to the trial court, the woman had said that after the three accused dumped her, she went back to locate the garage where she was raped before lodging the complaint so as to enable her to give proper evidence about the crime.

The woman's roommate, however, spilled the beans while deposing as a witness. She said the woman used to take financial help from the accused persons and, after completing her household work, used to indulge in prostitution at night. The roommate further told the court that the woman had approached the accused persons for Rs 1,000 which they declined to give.

When asked why she had lodged the complaint against the accused persons, the woman had said that it would have compelled them to pay the money she wanted.

The bench said, "This witness's version is plausible, and thus, fits in with the defence plea to demolish the prosecution case." Writing the judgment for the bench, Justice Roy said, "Her vengeful attitude in the facts and circumstances, as disclosed by her, if true, demonstrably evinces a conduct manifested by a feeling of frustration stoked by an intense feeling of deprivation of something expected, desired or promised."

Acquitting the three accused, Justices Ghose and Roy drew the conclusion, "We are of the unhesitant opinion that the prosecution has failed to prove the charge against the appellants to the hilt as obligated in law and thus, they are entitled to benefit of doubt."

Shring, do you honestly believe that women and women alone are contributing to all this mess? Dont say you already answered that. Think (just humour me) and tell me.

While I agree a few laws are favoured and flawed and side women. I, however simply do not agree that we have a grand plan going on to screw you men.
Damn, half the time I am wondering what should go in the weeks meal plan. Where does one have time these days to think/plan/execute all these plans to mess with men?

Women's shelters are used for a different right Shring. Say today I get beaten up and I am afraid for my life and the life of my child, I go to a shelter.
Say, I mess up royally, lose all money, no place to go, I become homeless. Are there shelters in winter? Sure. they are available for men too.

So many posts and I dont even know what to tell you anymore.
You ask how come so many dangerous positions are held by men. The perception is changing. I see so many women in construction sites these days. So many getting enrolled in Navy/Army etc.

Some professions were deemed feminine and some masculine (if I may say that). Say crochet. Have you come across a man who does crochet?

this is a different story altogether. i think you yourself have highlighted the part that distinguishes from my post. have i mentioned anything about sex workers being paid? it's one of life's bitter ironies that sex workers who deserve empathy are sent home bleeding, hurt, used, dejected. is this "no rape"? is the term rape only applicable when a woman, who has family, husband, brother, son, father, is sexually assaulted by any man?

Just thinking out loud here...if IF what Shring is saying is true, that women are wired to extract from men, then is it safe to assume that men will start (slowly) getting attached to men? I mean like gay? And women getting attracted to women?
I do believe that ultimately men and women need companionship. If they cannot find it with opposite sex, will they eventually look within their own gender?

If yes, how will the society be? Sperms for sale and wombs for rent? Is that a win win?

Men being attracted to men is already happening.
Women to women won't happen. They will keep coming after men.

No. I do not believe that women alone are contributing to the mess. I do not believe women are evil. I do not believe that there is a plot to screw men. I do not believe in any of this.

In Mao's regime, millions died in the "cultural revolution". Mao never wanted the people dead. They died because of the flawed nature of the policies. No Indian politician wanted people to be poor. But the flawed policies of licensing, coupled with idealistic zeal kept our people poor. The same with women's lib. This is the position -

i) Feminism has taught men and women certain ideas which are wrong (with genuine goodness in the heart, with no malice whatsoever)
ii) These ideas make society act in such a way that several men are hurt (it goes beyond some laws and some women abusing them - it is deeper - belief in some ideas)
iii) Enough men are already hurt that a critical mass of men are avoiding sex with women, but not porno stuff or dolls (> 5%). A critical mass of men are avoiding marriage ( > 10% over and above the 5% mentioned earlier )
iv) These men have no incentive to produce and are dropping off economically. They are also the "living examples" for others to drop off
v) The numbers of dropouts are so high that we are going to have a demographic-economic collapse. Millions will die

Basically, feminism is evil because its consequences are evil. Women are not evil. Women are not men-haters. But feminism will cause great hurt (eventually to women the most)

You forget, that just the way women are wired to extract from men, men are wired to chase women for their wombs. Every society had whores. Every society, including ours had systems to ensure that newer and newer women enter whoredom. On the other side of the equation, every society had men dying protecting, and men being maimed providing. Society has run on the wombs, honor and tears of women and the blood and sweat of men. Without these, societies will not function.

I'll tell my personal views about homosexuality. Read the experiment conducted called "Universe 25" or "Mice Utopia Experiment". It is terrifying. Read it from 2 or 3 different sources on the net.

How would you relate that experiment to females ? Do you mean to say females were the reason for population explosion ?

this is probably the view missing in the entire discussion. there is no one size fits all policy... just like all women will not run to men, all men will not run to women, all women will not run to women and all men will not run to men.

I also dont agree that men after womb.

I believe that men and women are after companionship. We are not meant to be alone. we will not survive alone.

Taking cue from your examples, when evil happens, it wont discriminate between men and women. Take Hitler, he was trying to wipe out a race.
Yes, men were fighting the wars historically, but when they did lose, their women were made slaves. So, it hasnt been all rosy for women too.

But I sure am glad you dont believe we have some evil intentions towards men.
