Labor Ministry threatens Huawei Technologies

Date: Tuesday, August 26, 2008

New Delhi: The Labor Ministry of India has threatened the closure of Huawei Technologies' business in India. The ministry has accused the Chinese telecom company Huawei for not following Indian laws to undertake operation in the country.

The company has been employing a large number of Chinese workers in India without proper visa and also not paying applicable income tax.

"Huawei is not paying applicable income tax for which they do not have immunity. This is in complete disregard to the law of the land and misuse of liberty leading to indulgence in fraudulent act," the notice said.

In the event of non-compliance and continued abuse of government regulations, the directors of the company, including the CEO, would be reprimanded by financial penalties or imprisonment and the government may ask the firm to close its business premises.

However, a company spokesperson said, "The company strictly complies with Indian tax regulations and mandates since inception. We have been paying our statutory liabilities in terms of personal income tax and corporate income tax regularly."

The centre made it clear that action would be taken against the company as its Chinese employees in India who hold business visa, are living in apartments illegally without having any resident visa and has asked the company to immediately repatriate all illegal Chinese workers from the country.

The spokesman said, "Our Chinese staffs who hold business visa routinely go back to headquarters once their training and customer care assignments are over and also go back for renewing their business visas."
Huawei started its operation in India in 1998 by establishing its first Research and Development centre followed by its marketing and sales office in 2002. The company also claimed that it employs approximately 1,100 employees and more than 99 per cent of these are Indian engineers and marketing professionals.

man it's time the Indian Govt shuts this company down or impose huge penalties. such blatant disregard. Everyone treats India like a dumping ground. I'll not blame them. But we have let it come to such state. Let's see how this tamaasha unfolds. I'll bet that our leaders will prostrate before the chinese and karat will make a huge deal out of it to keep his commy bosses in Beijing happy.

this company is typically chinese and has a notorious reputation.my frnds got placed in this company just this year..and they also told me about lots of chinese being brought in to work.they have even put a clause to their clients that they will bring more labour from china since indian labour is not efficient.i think its high time india should teach lesson to such companies.

"In this regard it is stated that no such notice has been issued by the Ministry of Labour and Employment," it added.

Huwaei, which manufactures telecom equipment in China and sells globally, including in India, has a reserach and development centre in Bangalore.

Reports in the media Tuesday said the ministry issued Huawei a notice Monday, accusing it of committing serious legal and financial violations, including tax frauds.

Even before the ministry issued the formal denial, a top company official told IANS his company was investigating the "authenticity" of the letter.

"We have 200 Chinese staff who have come to India on a valid business visa and who leave the country within the prescribed time limit once the discussions are over," the official said requesting anonymity.

He termed it as "a trick" to create a "scare" in the market so that Huawei loses out on upcoming bids for telecom tenders floated by various service providers.
"We will speak to the Labour Commissioner and tell him that someone probably is misusing the letterhead of the ministry," the official said.

After the ministry issued the statement, he said he was relieved. "We had never flouted norms and knew things will be fine."
