EAD question

Does anyone here have any idea -

how long u need to keep working for current employer after getting your EAD, (to keep legal status)

Is there a time frame during which you cannot switch to a job with another employer....

afaik...if 6 months have elapsed after the 485 receipt date, then you can quit and join another employer....

your I 140 has to be approved and 485 petition in - 180 days on your EAD and your GC application is portable AFAIK

I happen to know a bit about this.

There is a rule called AC21 portability. Google it.

Okay, as per the rule you need to work 180 days from the Notice Date of your I-485 application with the same employer.

Now, after 180 days you can quit, however your new job needs to be in a similar capacity. Many lawyers and websites have differing opinions, but this is what it all boils down to - Your new job should be categorizable as your job category in your Labour application.

For example, most of us have the category c(9) in our labour certification which says - c(9) means this job requires blah blah etc. skills.

So when the USCIS will ask you about your new job, your new employer should be able to prove that the new job is also the same category, for example, c(9).


Another sincere piece of advise - DO NOT believe whatever you read on websites but treat it as discussion and pointers to ask questions to your OWN IMMIGRATION LAWYER!!

What I have written here is correct BUT I am not a qualified attorney nor an Immigration officer. So please read such opinions, use them to create notes and points, and then consult your lawyer.

One more complication or change is that these days, I hear, you can apply for I-140 and I-485 at the same time. In such a case, I-140 approval is a definite must. Now you might get it in 6 months since you applied. Now it is not clear whether you start counting 180 days from date of I-140 approval or from the notice date of the I-1485 application.

As I said - Read all these websites, talk to friends, and then go consult your attorney.

I have seen cases and I cannot emphasise enough that many of us are over smart and think we know everything because some blog or forum said such and such a thing. BULL-FUCKING-SHIT!!!

Spend some money NOW and avoid headaches and problems later. Trust me, it helps. I was on the verge of trying something based on hearsay. Thank God, I had the sense to ALWAYS ask the dumbest of questions to my attorney.
