SCENARIO:
  • USCIS approves your H1B visa extension
  • you visit your home country to visit family and friends
  • you go to US Consulate (in your home country) to get your "approved" visa stamped
  • the US Consulate officer denies to stamp without a reason
  • You lose your apartment, car, furniture, clothes, electronics, etc. as you can't get back into USA.

Shouldn't USCIS deny the visa extension in the first place, rather than harassing skilled workers (most of them legal) ?

This is so true...

I missed my brother's wedding because of this. I was so scared to go to India (even when I had job and employer even had filed for GC) and face those idiotic consular officers who have become "babus' and disrepect everyone on the other side of the window.

Re: H1-B Visa Extension Denied

I saw somebody reading this thread, so thought of updating it with new found info since last 4 years.

Some terminology understanding needs to be clarified here.

What USCIS approves is a PETITION, saying that visa is recommended or can be granted up till the date they specify. Now once you go to American Consulate (in your home country or another country) they actually GRANT and STAMP the visa.

Off late, since may be more than a year, you need not appear for a visa interview based on certain conditions. One I know of is: If you are renewing your temporary work visa in the same category, with the same employer and it has not been a year since your petition has been approved. In this case, you pay your fees and when visiting your home country, you send in the papers and are given the visa within the said SLA.

Re: H1-B Visa Extension Denied

As per toilet-
https://m.timesofindia.com/india/new...w/64982365.cms

MUMBAI: Many H-1B visa holders could find themselves facing deportation proceedings if their application for a visa extension or change of status has been rejected and the tenure of stay granted originally by the US authorities (as reflected in Form 1-94) has expired. To make matters worse, despite no longer holding on to a job, they would have to stay on in the US for several months, waiting to be heard by an immigration judge.
A policy memorandum, dated June 28, which came into the public domain last week, permits the US Citizenship and Immigration Services to issue “notices to appear” (NTA) in cases “whereupon denial of an application or petition, the applicant is ‘unlawfully present’ in the US”. Such a notice is the starting point for removal or deportation proceedings.

Butt, anyone else too thinks Desi media and more so Toilet are exaggerating stuff in umrika.

I completely support the USCIS .. especially in throwing out Infosys from USA. Fuckers practice the worst things and screw their employees.. I have a friend in Infosys USA... He is at a client site.. He is a US Citizen and Infosys cannot fuck with him, but they routinely fuck with desi H1Bs.

Re: H1-B Visa Extension Denied

Trump should stop this nonsense by desis. All Desi IT companies screw desis and the us govt. Quoting a salary in visa application and giving something else is a routine practice. Desi IT companies are propagating old age bonded labor evil in a different form. They watch out for only the benefits of old timers in the company and their own gang. Worst are the Tamilian chutiyas who screw other Indians and will even eat shit of Caucasians.
